1. Introduction

www.terapia.com.pl is a website owned by the company Terapia Media sp. z o.o., publisher of Terapia monthly, based in Warsaw at ul. Jana Olbrachta 29/22, hereinafter referred to as the “Service Provider”. The website www.terapia.com.pl and other websites owned by the Service Provider together form a system (hereinafter referred to as “the System”).
The System is intended for people professionally involved in healthcare (physicians, pharmacists, dentists, nurses, paramedics etc., hereinafter referred to as “Users”) who want to gain safe and easy access to online materials and services offered by the Service Provider and third parties, including Partners and Clients cooperating with the Service Provider.
Within the System, the Service Provider and cooperating third parties, including Partners and Clients, send news on the latest developments in healthcare, information about articles published in Terapia monthly, guidelines for physicians, new therapies, conferences and training courses as well as other commercial information (e.g. on new drugs) to the e-mail address specified by the User.
The necessity for the User to provide identification data during their first visit to the website (registration) stems from the requirements of Polish law. Identification of the User, especially verifying their occupation, is essential because some of the medical information published on the website should not be shared with people other than medical professionals.

2. General provisions

The purpose of these Regulations (hereinafter referred to as the “Regulations”) is to set down the rights and obligations of the Service Provider and Users, and also the rules according to which a User, i.e. a person who is of age, with full legal capacity, professionally involved in healthcare (such as a physician, dentist, pharmacist, nurse, paramedic etc.), who fulfills the terms of the Regulations and has completed their Account Registration, may gain access to the System.
In the Regulations the User and the Provider will be collectively referred to as the Parties.
Following the User’s online registration in the System or written notification (registration) in accordance with the principles described in these Regulations and based on the relevant statements of the User and the Service Provider, the Service Provider agrees to provide the User with services consisting in enabling the User to access materials and information of interest to them that come from the Service Provider and third parties, including Partners and Clients cooperating with the Service Provider, and the User agrees to comply with the principles set out in the Regulations and to use the System in an honest and lawful manner, without disturbing its functioning.
Using the System is free of charge. Using some of the services available via the System may be subject to a fee, but in the case of such a service, the User will be clearly informed each time about the rules and amount of such payment before using the service.
The Service Provider does not verify and is not responsible for content published by third parties, including Partners and Clients cooperating with the Service Provider.

3. Registration, creating an account and accessing the System

An Account means an account maintained for the User by the Service Provider in an IT system, secured with an individual access password assigned by the User, as part of a set of resources, where the data related to it constitute personal data collected in the set of personal data indicated below, within which the Service Provider gathers data about the User, their personal data and information about their activities within the System (hereinafter referred to as the “Account”).
The Account constitutes an access service for the User once they register and log in to the website www.terapia.com.pl, and contains the User’s settings connected with the running of the above-mentioned website and other services that require logging in. At the same time, the account data are part of a data set.
A User may not have more than one account.
To create and register an Account enabling access to the System:

  • The User completes the registration form available in the System. The User is obliged to provide the requested mandatory information and to ensure its truthfulness, reliability and completeness.
  • The User is obliged to accept the Regulations and to consent to the processing of any personal data provided.

  • The User completes the application form, providing appropriate data, e.g. during a scientific conference, thus consenting to the processing of the personal data they provide, and the Service Provider immediately activates the User’s access account and sends information necessary for the first logging in (one-time login and password) to the e-mail address indicated in the form, together with a link to these Regulations, the acceptance of which is necessary to use all information, materials and services available on the website www.terapia.com.pl.
  • During the first logging in, the User changes the login and password and, if necessary, provides any missing data.

From this moment, the User gains access to the System and may use it in accordance with the terms of these Regulations.
The User may not use the System anonymously or using an alias.

4. Login (ID) and password security

The login (ID) and password of each User constitute personal and confidential information, therefore they are not allowed to be used by anyone other than the User to whom they were assigned. Each User is personally responsible for their login and password, therefore they are obliged to ensure the security and confidentiality thereof. In the event of loss or theft of the login and/or password, the User is obliged to immediately inform the Service Provider of this fact.

5. Updating registration data

A User with an Account in the System is obliged to immediately inform the Service Provider about any changes to the data provided during the registration process, in particular regarding their professional profile, which could affect the User’s status.

6. Verification of User data. Loss of the right to access the System

From the moment of entering data in the registration process, throughout the period of using the System, the Service Provider is entitled to check and verify the data provided by the User and the User’s professional status (their connection to healthcare), and also whether they meet other conditions necessary to create and maintain an Account in the System.
The Service Provider reserves the right to temporarily block access to the Account or deactivate the login and password in the event of:

  • the User providing unreliable, false or misleading information during the registration process;
  • the User’s failure to update their data in connection with any change that has occurred, no later than one month from the date of the change;
  • the User losing the status of a healthcare professional;
  • the User providing their ID and/or password to a third party or allowing a third party to gain access to the System using the current online session of another User;
  • the User using the System in a dishonest or illegal manner;
  • the User not using the System for a period of at least 12 months; in such a situation, the Service Provider will try to contact the User at least twice in advance by e-mail or telephone;
  • it being determined that the security of the Account or System is at risk.

7. www.terapia.com.pl and other websites run by the Service Provider

A User with an Account is entitled to use the website www.terapia.com.pl and other websites and online services offered by the Service Provider.
Access to the Service Provider’s other online services will take place after the User logs in to the Service Provider’s website.

8. Reporting complaints

The User may submit a complaint if the services covered by these Regulations are not properly provided by the Service Provider. Complaints must be submitted in writing or electronically.
A complaint is considered within 14 days of all the relevant data of the complaint being provided. The Service Provider has the right to request that the complaint be supplemented with other information relevant to its clarification. The response to the complaint is sent to the e-mail address assigned to the Account or another address provided in the complaint.

9. Cancellation of services

The User may resign from using the System at any time of their choosing.
To do so, the User should send a declaration of resignation to the following address: terapia@terapia.com.pl. The resignation becomes effective once the data are confirmed.

10. Intellectual property

Intellectual property rights to all content contained in the System belong to the Service Provider or other entities indicated by the Service Provider. The content contained in the System is made available to Users only for their individual use.
Restrictions on the use of content contained in the System do not apply to content that is not protected under intellectual property regulations, e.g. simple press releases, as well as content used under statutory permitted use.
If the User wishes to use any content contained in the System for purposes beyond the above scope, they may contact the Service Provider to conclude an appropriate agreement with the Service Provider or a third party, including the Service Provider’s Partner/Client.

11. Obligations of the Service Provider

The Service Provider agrees to exercise due diligence in connection with the provision of services and the operation of the System specified in these Regulations.
The Service Provider will make every effort to protect its System against unauthorized access and other threats.
The Service Provider will make every effort to ensure the System’s continuous operation. The Service Provider hereby warns that the System’s operation may be interrupted due to data updating, failure, damage, error repairs, and maintenance work. The Service Provider is not obliged to inform Users separately about a planned interruption in the System’s operation, but every effort will be made to ensure that a message about the interruption in the provision of services is posted on the System’s websites on an ongoing basis.
The Service Provider agrees to comply with all legal regulations in force in the territory of the Republic of Poland, in particular regulations on the protection of personal data and the provision of services by electronic means.

12. Obligations of System Users

By registering in the System, the User agrees to:

  • comply with the legal order in force in the Republic of Poland, in particular with regulations on the protection of personal data and on the protection of intellectual property rights, and to respect the principles of social coexistence, network etiquette, and the rights and personal interests of other Users;
  • comply with the rules set down in these Regulations;
  • use the System and information available within the System in a manner consistent with their intended purpose;
  • not use the System to distribute advertising (spam), pornographic or political content, and content that is contrary to the law and generally accepted principles of social coexistence.

13. Processing of System Users’ personal data

As described in the introduction to these Regulations, in order to enable verification of Users and, in accordance with the purpose of the System, to make it available only to a specific group of people, i.e. medical professionals, the User is obliged to provide certain identifying data at the registration stage. Using the System requires the User’s consent to the processing of these personal data.
The functioning of the System consists in providing the User with access to specific content and materials in which they may be interested and which correspond to their professional profile. Therefore, in order for the Service Provider to fully provide the services expected by the User, the Service Provider must process the User’s personal data for this purpose.
Personal data processing is necessary for the provision of the services offered by the Service Provider, therefore the User’s consent to the processing of such data is required. The Service Provider undertakes to apply appropriate measures to ensure the protection of each User’s personal data and to protect them against modification, damage or transfer to unauthorized third parties. The Service Provider processes the User’s personal data in accordance with applicable regulations, including the provisions of the Regulation of the European Parliament and of the EU Council (2016/679) of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as “GDPR”).

14. Scope of personal data processing

The data that are processed are the personal data provided during the User’s registration on the website www.terapia.com.pl:

  • mandatory data: name, surname, e-mail (login), registration date, user type (profession);
  • optional data: address, telephone number, place of work with address, telephone numbers of the place of work.

If the User submits their CV (or cover letter) for the purposes of a recruitment process carried out via the System (e.g. to acquire new authors of publications to be featured in Terapia monthly and on the website www.terapia.com.pl), data processing will also apply to data provided in such documents.

15. Method of personal data processing

Personal data will be processed in the Service Provider’s IT system, which meets the security standards provided for by law. Processing will be carried out mainly, but not exclusively, by automated means.
Personal data will be processed by the following means: gathering, recording, organizing, structuring, storing, profiling (i.e. automatic analysis of personal data in order to select persons to be covered by a given action: offer, e-mailing, etc.), downloading, viewing, using, matching or combining, limiting, deleting.
The Service Provider, i.e. Terapia Media sp. z o.o., will not transfer any personal data of Users of its website www.terapia.com.pl to other entities or entrust their processing to third parties.

16. Period of personal data processing

Personal data will be processed on the basis of the User’s consent until such consent is withdrawn.

17. Purpose and legal grounds

Personal data will be processed for the purpose of:

  1. making sure that access to the Service Provider’s website is provided to a specific professional circle (based on the User’s consent and the Service Provider’s legitimate interest);
  2. verifying the submitted data in connection with registering, logging in and using the website www.terapia.com.pl (based on the User’s consent and the Service Provider’s legitimate interest);
  3. verifying whether the User meets the conditions set down in the Regulations of the website www.terapia.com.pl, as well as the requirements contained in applicable legal provisions (based on the User’s consent and the Service Provider’s legitimate interest);
  4. recording and monitoring data on the use of the website www.terapia.com.pl by users, which may include analyzing visits to the website www.terapia.com.pl and measuring the performance of the System that supports it, as well as generating general reports (based on the User’s consent and the Service Provider’s legitimate interest);
  5. contacting the User as part of the System’s operation (based on the User’s consent and the Service Provider’s legitimate interest);
  6. providing commercial offers, services, products and educational kits as well as advertising materials from the Service Provider or third parties, including the Service Provider’s Partners and Clients (based on the User’s consent);
  7. archiving data processing activities (based on the Service Provider’s legitimate interest);
  8. making or verifying accounting entries (based on the Service Provider’s legitimate interest and the User’s consent or confirmed intent);
  9. verifying the User’s professional data at the Supreme Medical Council – Polish Supreme Chamber of Physicians and Dentists (NIL) (based on the Service Provider’s legitimate interest);
  10. recruitment processes (based on the User’s consent);
  11. contacting the User to invite them to participate in market research and statistical surveys (based on the User’s consent and the Service Provider’s legitimate interest).

18. Users’ rights

The User has the right to:

  1. access their personal data;
  2. rectify (correct, modify) their personal data;
  3. request that the processing of their personal data be limited;
  4. request the deletion of their personal data (be forgotten).

19. Objection

The User has the right to object to the processing of their personal data, including profiling, at any time.

20. Complaint

If the User decides that the processing of their personal data violates the law, they have the right to lodge a complaint with the President of the Personal Data Protection Office.

21. Opting out of using the website www.terapia.com.pl

The possibility of lawful processing of the User’s personal data is necessary for the Service Provider to run the website www.terapia.com.pl. Consequently, the User’s withdrawal of consent to the processing of their personal data specified as mandatory, or raising an objection in this regard, at the same time means giving up using the website www.terapia.com.pl and removal of the account enabling access to the website.
The User’s modification (correction) of previously provided personal data in such a way that the data specified as mandatory become incomplete, is tantamount to the User withdrawing their consent to personal data processing.
Withdrawal of consent does not affect the lawfulness of processing based on the User’s consent before its withdrawal.

Contact information for the Service Provider’s personal data protection administrator: Jarosław Kosiaty, e-mail: jaroslaw.kosiaty@terapia.com.pl. If the inspector is changed, information about the change will be posted on the website www.terapia.com.pl.

23. Providing services electronically

The Service Provider reserves the right to send e-mails to users. E-mails may concern the website and its functionality as well as other information related to using the website, e.g. the latest materials and news, comments, wishes, newsletters.
Anyone registering on the website www.terapia.com.pl agrees to receive informational, educational, promotional and commercial messages from the Service Provider by e-mail, including receiving the Aktualności Terapii [Terapia News] newsletter.

24. Cookies. IP addresses

Offering the System for use, the Service Provider uses cookies. Cookies are small temporary files that enable the Service Provider’s servers to collect information from the User’s web browser during each visit to the System (they are stored on the hard drive of the User’s computer). Cookies are necessary for the System to operate properly, and disabling them in the User’s browser hinders access to the Service Provider’s management panel and affects the availability of the System to the User.
The Service Provider uses the IP addresses collected during online connections for technical purposes related to server administration. In addition, IP addresses are used to gather general, statistical demographic information (e.g. about the region from which a User has connected to the website).

25. Content published by third parties, including Partners and Clients

The Service Provider does not verify the content and materials posted on the website www.terapia.com.pl by third parties, including Partners and Clients cooperating with the Service Provider.
The Service Provider has no influence over websites that are owned by these third parties, links to which are available on the website www.terapia.com.pl (in particular over what they convey and contain). In view of the above, the Service Provider is not responsible for the content or services made available on any other, external website of a third party, nor for any actions and decisions made by the User on the basis of such content or services. The Service Provider recommends that, when using the websites of these entities, the User read the regulations, policies and rules these third parties provide on those websites.
Pursuant to Article 23 section 1 point 1 of the Personal Data Protection Act, by completing a registration form provided by a third party, including a Partner or Client of the Service Provider, the User consents to the processing of their personal data provided in that form. The third party, including a Partner or Client of the Service Provider, is an entity that publishes and makes available materials that the User is interested in receiving. The third party, including a Partner or Client of the Service Provider, processes the User’s personal data for the purposes specified in its own regulations.
The User’s consent referred to above enables the Service Provider to provide the User with services consisting in delivering information and materials from third parties to the User, including from the Service Provider’s Partners and Clients.
The User’s consent in the above area is a voluntary and conscious expression of the User’s will.
The User may at any time withdraw their consent to the processing of their personal data by a given third party, including a Partner or Client of the Service Provider; this involves opting out of access to the services and content provided by that entity.

26. Liability of the Service Provider

Within the System, the Service Provider has no influence over the websites and online services of third parties, including Partners and Clients, and cannot be held responsible for them in any way. The Service Provider is not responsible for the behavior of Users or for their failure to comply with the regulations on using third-party websites, including those of Partners and Clients, and is not responsible for their violation of the provisions of those regulations.
The Service Provider’s liability is related only to the functioning of the System. The Service Provider will not be liable for the following damages:

  • those related to the suitability, quality, ownership of the System, and to its commercial usefulness and its suitability for a specific purpose;
  • those resulting from any actions or omissions of third parties with no ties to the Service Provider in connection with the User’s use of the System;
  • those related to the availability, operation, interruptions in the operation of the System, its failures, and the cessation of operation or provision of the System, if the Service Provider or persons acting on behalf of the Service Provider had no influence over this;
  • those resulting from following any facts, opinions, ideas, instructions, methods or procedures contained in the System or made available through it, and also from using them and taking actions and decisions based on them;
  • those resulting from viruses, worms, Trojans or other types of harmful software or from the fact of computer devices being infected, if the System is not their source.

Before taking any decisions or actions based on the content and materials contained in the System or made available after logging in using an Account in the System, Users should independently assess and verify them.

27. Force majeure

If the Service Provider’s performance of any of its obligations is prevented, hindered or delayed by an act of force majeure, the Service Provider will not be liable for non-performance, incomplete performance or delay in performance (as the case may be) of the obligations affected by such act of force majeure. For the purposes of these Regulations, the term “act of force majeure” includes fires, floods, earthquakes, other natural disasters or acts of God, riots, social unrest, rebellions, revolutions, military operations and terrorist attacks, industry-wide strikes and other circumstances of a similar nature, over which the Service Provider has no influence, as well as failures of the IT and electrical networks.

28. Changes to the Regulations

The Service Provider reserves the right to make changes to these Regulations at any time without having to justify the reason for such a change.
To enable Users to familiarize themselves with up-to-date Regulations, the Service Provider will include the date of the last update of the Regulations at the bottom of the page.
The Service Provider agrees to notify Users on the website www.terapia.com.pl about any significant change to the Regulations.
In the event of a significant change to the Regulations, in particular a change involving the rights and obligations of Users, the User will be asked to accept the new Regulations when first logging in after the change.

29. Applicable law and competent court

These Regulations and any claims, disputes or other types of proceedings (contractual or non-contractual) arising from these Regulations shall be governed by and interpreted in accordance with Polish law. If any of the provisions of the Regulations are deemed invalid or ineffective by a court decision, the remaining provisions shall remain in force.

30. Accepting the Regulations

By accepting these Regulations, the User agrees to act in accordance with the declarations and obligations arising therefrom.
The Service Provider is the host of the System.
The content of these Regulations has been proposed by the Service Provider for the comfort and safety of the User, as well as to ensure that the actions of both the Service Provider and the User remain consistent with applicable law.
Each User who gains access to the System accepts these Regulations and undertakes to comply with them upon first registering in the System. Acceptance of the Regulations is tantamount to the User’s declaration and assurance that they are over 18 years of age and have legal capacity.
By registering in the System and gaining access to it, the User also ensures and declares that the information the User has provided to the Service Provider is true and reliable, and therefore is not intended to mislead the Service Provider or any other entity.
By accepting these Regulations, the User undertakes not to violate any applicable legal provisions, including copyrights, patent rights, trademark rights or any other intellectual property rights of third parties, as well as codes of ethics, applicable professional regulations and guidelines, and principles of social coexistence.
